A South African Appellate judge has set a dangerous precedent by seemingly encouraging child rape. In a nation plagued by the sexual abuse of children, one would hope a panel of tenured judges would think twice before using the uniquely African, she’s only 10 but liked it argument, in a legal decision.
Wishful thinking on my part, I suppose.
By reducing the sentence of a grown man who groomed and repeatedly sexually assaulted a 10-year-old girl, he referred to as his daughter, for sex, they’ve in fact set a dangerously irresponsible message to paedophiles across South Africa, that if the child hasn’t kicked and screamed the entire duration of the sexual attack, a judge might show leniency during sentencing. I smell Harriet Harman’s work here.
Still, that’s exactly what transpired this past week.
The defendant, Molefe Joseph Mphanama, was sentenced to life in prison for raping his 10-year-old ‘friend’, until the appellate judge stepped in during the appeals process, and reduced it to 20 years.
Our EKP Pretoria correspondent reported that, “the life-sentence was reduced on appeal by the High Court because in their legal opinion she (the victim) seemed a willing partner.”
Mr Mphanama’s life sentence “was replaced with an effective sentence of 20 years imprisonment for his conviction on four rape charges”. In theory the man could be out in well under a decade.
The two appellate judges, appointed by the ANC, wrote in their decision that “the girl had visited Mphanama out of her own free will after the first rape” and her “unwillingness to have sex was only shown when she closed her thighs.”
Although I understand that the mentality and life experiences of a 10-year-old black African are markedly different to those of my daughter, the fact remains she was TEN, and should be viewed as such in the eyes of the law.
Throwing the book at this man would have sent a powerful message to South Africans that believe that sexual relations with children are less egregious than forcible rape. It would have TOLD these people, that even if the kid appears willing, you’re going to a very savage jail for a very very long time, if you touch her. Long jail sentences, aimed at scaring people into adjusting savage behaviour, can act as a deterrent and change the culture of the nation, if given the chance.
But the short-sighted liberal judge, more concerned with individual defendants’ rights, than the good of his nation, didn’t see it that way.
Liberals have a predilection for encouraging, even promoting immorality and paedophilia.
In Britain, Cultural Marxist and Labour Party MP, Harriet Harman, who the Guardian once referred to as the most influential woman in British politics, actively campaigned to have the age of consent lowered to twelve, during her stint as a Human Rights activist. While working as head legal counsel for a left wing human rights quango, she defended and/or represented clients that had been accused of taking inappropriate photographs of children and engaging in acts of sexual abuse. One of her organisation’s top clients and donators was in fact the notorious Paedophile Information Exchange. This vile woman, who referred to Afrikaaner people as ‘bastards’, and whose twisted mug symbolises Britain’s sexualisation of children, still defends her work on behalf of paedophiles to this day!
While the vast majority of British males still see children as off limits, the same can NOT be said for South Africa’s majority, where blacks in particular identify children as sexual prospects-evidenced by SA’s exorbitant child rape statistics. In fact the EKP research team reported that 41% of South Africa’s rapes are perpetrated against children under the age of 12, with 96% of those incidents, perpetrated by black men and women. There’s no denying that South Africa has seen incidents of child rape skyrocket since 1994, due to the nation’s political move to the left, where paedophilia is now not only condoned, but seemingly encouraged by the law, clergy and media. White liberals, like Harman in Britain, and Sue Van der Merwe in SA, are behind widespread societal and moral decay, and the belief that if it feels good, do it-an urge primal individuals have a hard time controlling.
The impact this political shift has had on South Africa has been catastrophic. SA is now the rape and child rape capital of the world, seeing 23 times more child rape per capita than even the most ‘rape friendly’ nations of Eastern Europe and Sweden.
And it’s being condoned by the media, legislature and clergy.
Only several weeks ago a South African cardinal, who’d helped elect Pope Francis, described paedophilia as a “psychological illness and not ‘a criminal condition'” during a trip to Engand.
The DM reported that, “The Catholic Archbishop of Durban, Wilfrid Fox Napier, told BBC Radio 5 live that people who were abused as children and became paedophiles were not criminally responsible for their actions in the same way as somebody ‘who chooses to do something like that’.
Cardinal Napier, who was among the 115 cardinals in the conclave at the Vatican that elected Pope Francis earlier this week, called paedophilia a ‘psychological disorder.
On the radio program, that will serve as further justification to paedophiles, Napier, snapped at the interviewer when he called sexual abuse a crime. Instead of making people feel gulty for their actions, Napier appeard to excuse them, stating that, “people can’t be blamed when they’re unwell.”.
This line of thinking is truly destructive, as guilt, is often the one thing standing between a child being raped, and not. People who are able to keep their paedophilic urges in check, because of either fear of punishment, or guilt, have been all but handed a free pass by the South African cardinal.
Napier told the BBC, ‘What do you do with disorders? You have got to try and put them right. If I as a normal being choose to break the law knowing that I am breaking the law, then I think I need to be punished. From my experience paedophilia is actually an illness, it is not a criminal condition, it is an illness.’
He continued. ‘Don’t tell me that those people are criminally responsible like somebody who chooses to commit an actual crime.”
Any wonder why child sex abuse is at an all-time high in the rainbow nation?
And like many of our stories, the sexualisation of children in South Africa transcends colour. We reported on white liberal children having sex with men twice their age, while they kill animals for fun, this past week-a story the liberal media are deliberately ignoring.
In their decision the judges stated, and we quote, “there was reportedly no evidence that she (the victim) had experienced any negative psychological symptoms for the rape.”
That speaks volumes about black South African culture and mentality.
